The Stockton Fire Department was called to the scene to put out the blaze and remove whoever was inside the vehicle. At least one person died in the crash. No information on injuries was provided. Traffic was backed up to Downing Avenue, and a SigAlert was issued until the accident scene could be cleared. The CHP traffic collision unit is handling the investigation into the accident’s cause and will assign the fault.

Time Limit to File for Wrongful Death

In California, the statute of limitations for filing a wrongful death claim following a fatal rollover crash is two years. This means that affected parties must file their claim within this two-year window. Failure to do so will result in the court dismissing the case.

Accidents and Wrongful Death Claims

When a fatal rollover crash leads to the death of a family member due to a negligent driver, the family of the deceased may have the right to file a wrongful death claim for compensation. An experienced accident attorney can help identify the legally responsible party and assess whether their negligence caused the death. Typically, the surviving spouse and children file a wrongful death claim. However, if the deceased had no spouse or children, other family members, such as parents or siblings, may be eligible to file.

Negligent Actions That Cause Accident Fatalities

Most wrongful death claims resulting from a fatal highway accident in Stockton are settled through the at-fault party’s insurance company. To pursue a personal injury or wrongful death lawsuit, it is crucial to demonstrate that another party’s negligence or reckless behavior caused the accident. An attorney can gather and present evidence to support your claim, including accident reconstruction, witness statements, surveillance footage, vehicle and roadway damage assessments, and police reports.

Recoverable Compensation in a Wrongful Death

In a wrongful death claim, commonly recoverable compensations include:

  • Funeral and burial or cremation expenses for the deceased
  • Lost wages the deceased would have earned until retirement
  • Loss of consortium, affection, and love for the surviving spouse
  • Loss of nurturing and affection for the children of the family
  • Loss of household assistance
