Fatality Occurs on El Centro Road in North Natomas Pedestrian Accident

A North Natomas pedestrian accident resulting in a fatality occurred on July 4 in a collision involving a motorist. The accident happened at the intersection of El Centro and Radio roads at about 4:15 a.m., according to the California Highway Patrol (CHP). The CHP said the driver involved in the crash stayed at the accident scene and cooperated with police. The driver did not appear to have been impaired. An investigation by CHP traffic detectives is determining how the collision occurred.

Negligence Leading to Wrongful Death

To pursue a wrongful death claim, it is essential to prove that another individual or entity’s negligence resulted in a pedestrian’s fatality. An injury attorney plays a crucial role in this process by conducting thorough investigations and compiling evidence to substantiate the victim’s family’s claim for damages. This process includes analyzing police reports, conducting interviews with witnesses, and obtaining surveillance footage, among other investigative methods.

Armed with this evidence, a seasoned injury lawyer will build a solid case to negotiate with the at-fault party’s insurance provider or pursue legal action in court if necessary. Insurance negotiations are generally successful, but the insurance provider refuses to pay what the injured pedestrian deserves in a small percentage of cases. In those cases, the matter is taken to civil court. Evidence gathered to support the compensation claim can be used in either instance.

Compensation Recovery After a Wrongful Death

Families who file a wrongful death claim after a North Natomas pedestrian accident caused by someone else’s negligence may be entitled to substantial compensation. The pedestrian accident claim is typically initiated by the deceased’s surviving spouse, partner, and children. In the absence of a spouse or children, other family members, such as siblings and parents of the decedent, may step in to file the claim. Recoverable damages include the following:

  • Reimbursement is made for the loved one’s funeral and burial expenses incurred by the family members.
  • The deceased’s potential earnings up to the expected retirement age are recoverable. Included is compensation for their insurance and pension benefits, bonuses and other monies they would have received.
  • Compensation is recovered for the personal losses suffered by spouses and children. The surviving spouse can recover compensation for their loss of consortium, love, and affection. The family’s children can recover compensation for their loss of nurturing and parental guidance.
  • The economic value of household tasks previously handled by the deceased that now require paid external services is recovered. Household tasks include lawn and vehicle care, childcare, cleaning, cooking, and others.
