Pedestrian Killed in Tahoma Fatal Accident at S.R. 89 Intersection

A Tahoma fatal accident involving a pedestrian occurred on July 22 when a Hayward man, 53, became pinned between a semi and a pickup. The accident occurred around 12:52 p.m. at the State Route 89 intersection with Pine Street in a shopping center parking lot. The California Highway Patrol (CHP) reported that one of the involved vehicles, the pickup was rolling backward, which led to the fatality when the pedestrian tried to stop it.

Cal Fire first responders arrived at the scene to provide medical assistance. However, the person on foot died, although it is unknown whether the event occurred at the scene or later in a hospital. An investigation is underway by CHP traffic crash detectives to determine the fault and how the incident occurred.

What a Wrongful Death Lawyer Does

In cases where a family has lost a loved one in a Tahoma fatal accident, a wrongful death lawyer will evaluate the case to determine liability. If the driver of a vehicle or another entity is found to be at fault, the family may proceed with a wrongful death claim.

Role of a Wrongful Death Lawyer

For families affected by a fatal accident, a wrongful death lawyer plays a crucial role in securing compensation. The lawyer will:

  • Evaluate the case: Determine liability for the fatal incident.
  • Investigate fault: Collect evidence, such as witness statements, accident reconstructions, and surveillance footage, to support the claim.
  • Build a strong case: Use the gathered evidence to construct a compelling wrongful death claim.
  • Negotiate with insurance companies: Seek fair compensation from the at-fault driver’s insurance company.
  • Litigate if necessary: If a satisfactory settlement can’t be reached, the lawyer will take the case to court to ensure the family receives the rightful compensation.

Damages Recoverable in a Wrongful Death Claim

The family members of a deceased individual, including spouses, children, and other dependents, have the right to file a wrongful death claim in the event of a Tahoma fatal accident. The types of damages that may be recoverable include:

  • Funeral, cremation, and burial expenses: The costs associated with funerary services can be recovered.
  • Lost wages and benefits: Compensation for the lost wages of the deceased up until their expected retirement age, inclusive of pension, insurance, and other benefits.
  • Loss of consortium: The surviving spouse may claim for the loss of companionship, love, and affection.
  • Loss of parental guidance: Children, whether biological, adopted, or stepchildren who were financially dependent on the deceased, may claim the loss of parental care, love, and nurturing.
  • Household services: Compensation for services provided by the deceased pedestrian, such as household chores and home maintenance, can be claimed.
