Investigation of Anderson Bicycle Accident Will Determine Fault

The condition of the rider and whether the motorist remained at the scene are unknown. The CHP traffic crash unit is investigating to find out how the accident occurred.

Injuries in a Bicyclist/Motor Vehicle Intersection Collision

Bicyclists are particularly vulnerable at intersections, where the dynamics of traffic can lead to a variety of injuries in accidents involving motor vehicles. Common bicyclist injuries at intersections include:

  • Fractures (especially to the arms, legs, and collarbone)
  • Contusions and abrasions (from being struck or falling)
  • Head injuries (such as concussions or skull fractures)
  • Soft tissue injuries (including sprains and strains)
  • Road rash (from contact with pavement)
  • Pelvic injuries (due to impact or falls)

Liability in Bicycle Accidents

Determining liability in a bicycle accident involves assessing the circumstances surrounding the incident and identifying the party at fault. Generally, motorists are held to a higher duty of care to avoid causing harm to cyclists, as bicycles are often more vulnerable participants in traffic. However, cyclists must also adhere to traffic regulations; failing to do so can complicate liability claims.

Ways a Driver Can Cause an Intersection Accident Involving a Bicyclist

  • Failure to yield: Not yielding the right of way to a bicyclist at intersections can lead to collisions.
  • Running a red light: Disregarding traffic signals can result in a driver striking a cyclist who is legally crossing.
  • Turning without checking for bicyclists: Quickly making a right or left turn without looking for approaching cyclists may cause a bicycle accident.
  • Distracted driving: Engaging in activities such as texting or using a mobile device can divert a driver’s attention away from the road and hinder their ability to see cyclists.
  • Speeding: Excessive speed reduces a driver’s reaction time, making it difficult to stop in time to avoid hitting a bicyclist.
  • Poor visibility: Driving without adequate lighting or in adverse weather conditions can impair visibility, increasing the risk of an accident.
  • Exiting a driveway or parking lot: Failing to check for cyclists when pulling out from a driveway or parking space can lead to unexpected collisions.

Recoverable Compensation in a Personal Injury Claim in California

In California, individuals pursuing a personal injury claim may be entitled to compensation for various types of losses incurred due to the incident. This can include reimbursement for medical expenses, lost wages, and other related financial burdens. Additionally, claimants may seek compensation for the impact the injury has had on their quality of life, encompassing pain and suffering, emotional distress, and other intangible losses. It’s important for individuals to understand the full scope of recoverable compensation to advocate for their rights during the claims process effectively.
