Why a Family Might Consider Pursuing a Wrongful Death Lawsuit
Families often choose to file a wrongful death lawsuit when a loved one has passed away as a result of someone else’s negligence or intentional actions, such as in the case of a fatal highway collision. While this legal action won’t alleviate their grief, it can help prevent financial hardship from the loss. Additionally, pursuing a wrongful death claim may provide the family with a sense of closure and a means of seeking justice for their tragedy.
What Can Be Recovered in a Fatal Highway Collision Wrongful Death Claim
In cases of wrongful death, spouses and children who relied on at least half of the deceased’s support are eligible to file a lawsuit due to a fatal highway crash caused by another’s negligence. Alternatively, the estate representative may file the lawsuit, but only one claim can be pursued. If the deceased had no spouse or children, other relatives, including siblings and parents, may file. Recoverable damages in a wrongful death claim may include:
- Compensation for medical expenses incurred before the death can be sought through a survival action.
- Spouses may seek compensation for consortium losses, including comfort, affection, and emotional support.
- Families can recover costs associated with funerals, cremation expenses and burials.
- Children within the family may claim losses stemming from the future lack of the deceased’s care, training, nurturing, and guidance.
- The estate’s beneficiaries might be compensated for losing any inheritance they would have received had their loved one lived.
- Compensation may be sought for the loss of household services, such as home upkeep, child care and vehicle and yard maintenance.
- Earnings that the decedent would have accumulated throughout their working life until retirement can also be recovered, including benefits such as insurance, pensions, and bonuses.
- Depending on the specifics of the case, families may also pursue punitive damages in civil court to penalize the offender and deter similar actions in the future if the circumstances of the death were particularly egregious or intentional.
