Investigation Being Conducted in Cause of Sacramento Fatal Pedestrian Crash

The cause of the crash remains unclear, but authorities have confirmed that no other injuries were reported. Sacramento police are actively investigating to determine the circumstances surrounding the accident and any potential fault.

Evidence Collection in Pedestrian Wrongful Death Cases

In all personal injury cases, including wrongful deaths in a Sacramento fatal pedestrian crash with a bus, lawyers rely on investigators to gather evidence supporting their clients’ claims. The investigation into a pedestrian wrongful death follows a similar methodology as other types of accident cases, including the following steps:

  • Investigators examine the police report for any potential errors that may need addressing.
  • Footage from surveillance cameras located at nearby businesses, residences, and traffic cameras is sought, as video evidence captured during the fatal pedestrian intersection crash can be incredibly persuasive.
  • Witnesses to the incident are interviewed; in some instances, witnesses may have recorded the accident on their cell phones.
  • Accident reconstruction is conducted to illustrate the positioning of the pedestrian about the vehicle, which can help establish fault.
  • The accident site is carefully searched for physical evidence, such as metal and paint from the vehicle, tire tread marks, and roadway damage. Photographs of the location are also taken.

Initiating a Wrongful Death Claim and Determining Eligibility

Typically, the spouse and children of the deceased individual in the Sacramento fatal pedestrian crash are the primary parties who file a wrongful death claim, as they hold priority in the process. If the decedent leaves no spouse or children, parents and siblings may file instead. Additionally, the estate administrator can initiate the claim if the deceased had prepared a will. Since only one wrongful death claim is permissible, there must be a consensus regarding who will benefit from the claim.
