How Do I Know If My Family Can File a Wrongful Death Claim?

A wrongful death claim is a legal action brought by the survivors of an individual who has died as a result of someone else’s negligence or intentional act. These claims hold the responsible parties accountable for their actions and provide financial compensation to the deceased person’s family or estate. Typically, wrongful death claims can arise from a variety of circumstances, including auto accidents with pedestrians.

For a wrongful death claim after a Stockton pedestrian fatality to be successful, it must typically be proven that the defendant’s misconduct or negligence directly caused the death, that the deceased’s family members have suffered financially due to the death, and that a personal injury claim could have been filed if the deceased had survived.

What Members of the Family Can File a Wrongful Death Claim?

The deceased person’s surviving spouse, domestic partner, and children are at the forefront of those who can take legal action. If no surviving individuals are in these categories, the right to file may extend to include parents, siblings, or other relatives.

Is There a Time Limit to File a Wrongful Death Claim?

The claim must be filed within two years from the deceased’s death date in the Stockton pedestrian fatality accident. This period ensures that claims are made while evidence is still relatively fresh and accessible and witnesses’ memories are clear. However, exceptions or specific circumstances, such as cases involving government entities, could affect this timeframe.

The deceased’s family must consult a legal professional to understand any nuances or particularities related to their case, ensuring their claim is filed within the deadline. Missing this deadline may result in the family losing their right to pursue legal action for wrongful death.
