Negligence Leading to Injuries or Death in Accidents

When filing a personal injury or wrongful death claim after a fatal Stockton accident, proving that someone else’s negligent or reckless behavior caused the car accident is crucial. Your lawyer will investigate the circumstances and gather evidence to support your case. Key evidence in such claims often includes accident reconstructions, witness testimony, surveillance videos, analysis of vehicle and roadside damages, and the official police report.

Types of Compensation in a Wrongful Death Lawsuit

In a wrongful death lawsuit, several forms of compensation may be recoverable to support the surviving family members as they cope with the loss, including:

  • Expenses for the decedent’s funeral and burial or cremation can alleviate the financial burden of these necessary final arrangements.
  • Wages the decedent would have earned until retirement age replaces the loss of the deceased’s earning capacity.
  • Loss of consortium, affection, and love for the surviving spouse acknowledges the emotional and relational impact of losing a life partner.
  • The loss of nurturing and affection that the family’s children would have received recognizes the detrimental effects on the growth and well-being of the children.
  • Loss of household assistance compensation is for the domestic contributions the deceased would have continued to provide.
