Recovering Compensation in a Wrongful Death
The spouse and children of a loved one who died in a car collision in a DUI crash caused by someone else can file a wrongful death claim. If the deceased has no immediate family, the siblings and parents can file instead. Recoverable damages include:
- Surviving children can claim compensation for the loss of parental guidance, love, and nurturing.
- Families can recover from the loss of services the deceased provided in the household, such as cooking, cleaning, lawn and auto care, and child care.
- Funeral and burial expenses can be reimbursed through the claim.
- The spouse or domestic partner may recover for the loss of consortium, companionship, care, and moral support.
- The deceased’s lost future earnings, up until they have reached retirement, can also be claimed.
By filing a claim, families ensure they receive the necessary financial support and seek accountability for their loved one’s untimely death.
