Recovering Financial Compensation in a Car Crash Case
A motor vehicle collision may be traumatic and life-altering in and of itself. Whether it is two or more vehicles, the aftermath is often emotionally, financially, and physically devastating. This is especially true when serious injuries are involved. It may take weeks, months, or years to recover from the incident. If another motorist was responsible for the car crash, an injured party may be entitled to financial recovery for their medical bills, wage loss, and other damages. This requires filing a personal injury claim against the at-fault party and their insurance company.
The statute of limitations for filing a case for personal injury in civil court is two years, according to CCP 335.1. The clock starts ticking on the date of the motor vehicle collision or another type of incident causing harm to another individual. This must be followed closely, especially if a settlement is not reached with the insurance company within that time limit. The case must be filed in court before the statute of limitations expires, or the court may dismiss it for failure to protect the statute.
The best way to ensure that your claim is filed within the statute of limitations is to retain legal counsel right away.
