Workers’ Compensation vs. Filing a Wrongful Death Claim
Workers’ compensation and wrongful death claims are two distinct legal avenues available, each with specific purposes and requirements. Workers’ compensation is typically a no-fault system designed to provide financial benefits to the family of the deceased employee without the need to prove negligence or fault. These benefits may include coverage for funeral costs, lost wages, and ongoing financial support for dependents.
On the other hand, filing a wrongful death claim involves seeking damages through a lawsuit, usually when negligence or misconduct is believed to have contributed to the individual’s death. Wrongful death claims allow families to pursue a wider range of damages, including emotional pain and suffering, loss of companionship, and punitive damages in certain cases. However, proving negligence is essential for a successful wrongful death claim, which often requires legal expertise and evidence collection.
When a Family Can File a Wrongful Death Claim vs. Going Through Workers’ Comp
Determining whether a family can file a wrongful death claim or must rely on workers’ compensation depends on the circumstances surrounding the individual’s death and the laws governing workplace-related fatalities in their jurisdiction. Workers’ compensation is generally the exclusive remedy when an employee dies due to a workplace accident or job-related illness, as it typically bars families from filing lawsuits against the employer. This system ensures timely benefits, such as covering funeral costs and providing financial support to dependents, without the need to prove fault.
However, there are situations where families may pursue a wrongful death claim instead of, or in addition to, workers’ compensation. If the death was caused by a third party’s negligence or intentional act, such as a contractor or equipment manufacturer, the family may have grounds for a wrongful death lawsuit. Consulting an attorney familiar with these legal distinctions can help families choose the right path and maximize the compensation they may be entitled to receive.
