Can Another Driver Be Liable If Your Vehicle Is Hit While Passing?

Determining liability in a head-on collision while passing depends on the specific circumstances of the accident. If the other driver was engaging in reckless behavior, such as speeding, crossing the centerline, or failing to yield, they may share or bear full liability. However, the driver attempting to pass also has a responsibility to ensure it is safe to do so, including checking for clear visibility and sufficient distance.

Ultimately, liability may be shared between both parties depending on the evidence and the traffic laws applicable in the location of the accident. Consulting an experienced accident injury lawyer can help clarify the fault in these situations.
