What Can Be Recovered in a Personal Injury Claim?
Injuries from a traffic collision may not only result in physical pain, but they may also affect injured parties psychologically and emotionally. In addition to this, there may be mounting medical expenses and lost earnings from time taken off work to recover from a car accident. Such losses may be significant, particularly when there are serious injuries involved. If the wreck was the result of another driver’s negligence, a bodily injury claim may be filed against them to seek compensation for damages incurred.
Personal injury cases may include recovery of medical bills, wage loss, and pain and suffering. Out-of-pocket expenses may also be recoverable so long as they are proven to be reasonable and necessary through clear and compelling evidence. This may include prescription medications that are needed to manage the symptoms of accident-related injuries, medical appliances, and renovations to the home or vehicle for those left with a permanent disability after an accident.
Remember that strict time limits apply to these cases. A lawsuit must be filed within a two-year window, starting on the date of the incident. Failure to file suit may result in the dismissal of the case. That is why it is recommended to work with an injury attorney in Fremont who will work to ensure that all aspects of your case are addressed and handled accordingly.
What if the At-Fault Party Does Not Have Auto Insurance?
While driving without liability coverage is illegal in California, many motorists continue to do so. When a driver without auto insurance causes a traffic collision, injured parties may be unsure of how to seek reimbursement for their losses. Fortunately, those in such situations that carry uninsured and underinsured motorist coverage may bring a claim through their policy.
At our law firm, our accident attorneys have extensive experience in handling personal injury cases. We will use our knowledge of these requirements and when UM coverage may apply. For instance, if the at-fault party has liability coverage but insufficient limits to pay for losses from accident-related injuries, UIM coverage may be utilized to pay for the difference.
