Common Pedestrian Accident Injuries
Pedestrian accidents can often result in serious and debilitating injuries. This is due to a walker’s lack of physical protection against a motor vehicle in a collision. Some of the common pedestrian injuries in such accidents include amputations, bone fractures, internal organ trauma, spinal cord damage, traumatic brain injuries, and more. In some cases, pedestrian accidents can result in wrongful death.
Pedestrian Accidents and Wrongful Death
Losing a loved one in a pedestrian accident is a tragic, life-changing experience. There would be many emotions related to the sudden and untimely death of a family member, especially if the loss was caused by wrongful death. When a fatal pedestrian accident is caused by a negligent driver, surviving family members of the deceased may turn to a wrongful death claim to recover from their loss. While no amount of money will bring back a lost loved one, monetary compensation can lessen the financial hardship and help move a family forward after such a tragedy. Recoverable Damages in a Wrongful Death Claim
The types of damages that may be recovered in a wrongful death claim may vary from case to case. However, families of victims may generally reclaim compensation for the following:
- Any accident-related medical expenses incurred before a loved one’s death may be recovered in a survival action
- Any post-life expenses, such as costs of a loved one’s funeral and burial
- Benefits lost such as medical insurance, pension, etc.
- Financial support the deceased would have contributed to the family during his or her lifetime
- Loss of consortium, if a domestic partner or spouse is suing
- Value of household services provided by the deceased
