Fair Oaks Boulevard Accident Results in Death of Pedestrian

A pedestrian fatality occurred in Fair Oaks the evening of June 7 after the walker was hit by a motorist in a Ford Fusion. The collision occurred along eastbound Fair Oaks Boulevard, where it intersects with New York Avenue, just after 9:00 p.m., according to the California Highway Patrol (CHP). The individual who died was identified as a Fair Oaks resident, age 59. He was taken by emergency responders to a nearby hospital with injuries that were life-threatening and passed away the next morning. The pedestrian’s identity has not been released pending notification of the family by the coroner’s office.

Motorist Remains at Scene of Pedestrian Fatality

The motorist who struck the pedestrian, a Sacramento woman, age 43, remained at the scene of the pedestrian fatality and was cooperative with investigators. She said the walker had been in an area of Fair Oaks Boulevard that was along a dark stretch. The woman was not placed under arrest by the police and is not suspected of having used alcohol or drugs. The North Sacramento office of the CHP is asking that anyone with information or who saw the accident to call them at (916) 798-0975 or (916) 348-2317.

Pedestrian Accident Injuries and Fatalities

Pedestrians often suffer severe injuries or become fatalities when they are struck by a motor vehicle. Because of their lack of protection against a heavy metal car, they stand little chance of walking away unharmed. In addition, the faster the vehicle is going, the more serious the injuries and risk of death to the person on foot. A lawyer experienced in handling these types of cases can help the grieving family obtain compensation for the loss of their loved one if negligence was the cause.

Investigation of a Pedestrian Death

Conducting a thorough investigation to collect evidence following a pedestrian fatality is important. Not only does it uncover the true reason for the person’s death, but it also helps the family if they wish to place a compensation claim for their loss. My law office has the resources, experience and know-how to collect the evidence needed to support a wrongful death claim. This not only helps the family financially, but it also holds the at-fault party responsible. We begin by sending our investigators out to the accident site as quickly as possible. Some of the areas in which an investigation is conducted include:

  • Government negligence, which can include poor lighting, untrimmed trees and shrubs that obscure a motorist or pedestrian’s view and others
  • Checking the police report for mistakes and talking to the witnesses
  • Searching for business and traffic surveillance cameras that may have captured the accident on tape
  • Performing accident reconstruction, which is forensic evidence that shows the positioning of the person on foot and the vehicle before, during and after the pedestrian fatality

After the evidence is compiled, our lawyers use it to construct a case for the benefit of our client. It is used when dealing with an insurance company on the client’s behalf. Sometimes, the insurance company is unwilling to pay what the client deserves, and it is used to present in civil court.

Grief Following a Death in the Family

The loss of a loved one is a difficult process to go through and emotions can range from disbelief and grief to anger and others. However, there are ways to show you care. Some of the ways in which people express their sympathy and support include:

  • Call or visit, send a sympathy card or flowers.
  • Offer to run errands such as grocery shopping, picking up the children at school or other needs.
  • Send over prepared food or invite the grieving person out to eat.
  • Help around the home, such as mowing the lawn, washing dishes, etc.
  • Remember to keep in touch frequently following the funeral services.
