Family Hospitalized After Fresno Rollover Accident
A family was hospitalized after a Fresno rollover accident on the night of May 23, 2019. The car wreck occurred shortly after 5:00 p.m. at 3rd Street and Iowa Street. A family of four, including a mother, grandmother, and two children, were driving together in a vehicle when it was involved in a collision with another car. The impact of the crash caused the first vehicle to overturn and knocked down a power pole in the process. The four occupants of the first vehicle were all transported to a hospital for treatment of unspecified injuries. An update regarding the conditions of those injured has not yet been released by officials.
Investigation of the Fresno Rollover Accident
The cause of the rollover accident is under investigation by the Fresno Police Department. However, authorities said the driver of the other car allegedly fled the scene moments after the crash. Authorities later tracked down and arrested the motorist on multiple felony charges including driving under the influence and hit and run.
What Are the Common Causes of Rollover Collisions?
A rollover can occur due to a wide array of circumstances that can cause a motorist to lose control. These include:
- A driver running you off the road
- Another car crashes into the side of your vehicle or your tire
- Poor road design or conditions
- Speeding or taking turns and curves too fast
- Striking a pothole or curb
- Vehicle equipment failures such as faulty brakes or defective tires
Roof Crush Resistance in a Rollover Crash
While most cars have reinforcements to prevent the roof from collapsing inward, rollover accidents can still result in serious injuries or wrongful death, as well as immense mental trauma and property damage. Under Federal Motor Vehicle Safety Standard No. 216, automakers are required to manufacturer vehicle roofs that can handle a minimum of 1.5 times the weight of the car. If this standard is not adhered to by the vehicle manufacturer, they may be held liable for injuries and damages caused by a crushed roof.
What Damages Can Be Recovered in a Rollover?
Depending on the facts and details of the case, a Fresno rollover accident attorney can seek specific personal injury damages incurred due to the accident. These include:
- Economic Damages: These represent accident-related losses that have affected an injured party financially, such as medical expenses. Other financial losses that may be recovered include any lost wages, loss of earning potential, lifestyle accommodations due to permanent disability, and any property damages.
- Noneconomic Damages: These are intangible harms that are factored into a settlement for a personal injury case. They represent how the rollover has affected the injured person’s quality of life. Noneconomic damages recoverable in a rollover accident case include disfigurement, emotional distress, loss of consortium, lost enjoyment of life, and pain and suffering.
- Punitive Damages: These are not awarded for compensation. Instead, they are designed to penalize a negligent party for their acts of fraud, oppression, or malice and to prevent them from engaging in similar conduct in the future. These damages are only available in cases of egregious acts such as drunk driving.
Should I Hire a Fresno Injury Lawyer for a Rollover Accident?
Even the most cautious of drivers can find themselves involved in a rollover accident. When a negligent driver fails to comply with road safety standards, an injured party should not have to pay for their error. Establishing negligence for a car wreck can be challenging and may require many resources an injured person may not have. Without sufficient evidence, an injured individual may receive little to no compensation for their damages. In these situations, an injured party should seek assistance from a Fresno injury attorney who is experienced in proving fault in a rollover accident case. This way, their right to fair compensation will be protected.
