Details on the Fatal Accident on Bacon Road Near Salida
A preliminary report by authorities revealed that a 19-year-old Modesto man was driving a Honda CR-V southbound on Jackson Road while a Dodge Ram was headed eastbound on Bacon Road. For unknown reasons, the Honda driver allegedly ran the posted stop sign at the intersection and entered the direct path of the Dodge, CHP traffic officers said.
Investigators said the Dodge did not have a posted stop sign and the pickup truck reportedly struck the passenger side of the Honda. The impact of the collision propelled both vehicles off the road, and they came to a rest in an almond orchard.
The Honda driver was transported by air ambulance to a Modesto area hospital for treatment of serious injuries. The Dodge driver, a 62-year-old man from Salida, suffered injuries described as minor in the traffic collision. Sadly, a passenger in the Honda, a 19-year-old Modesto man, suffered fatal injuries. An investigation into the two-vehicle crash is ongoing, and no further details were immediately available.
What Families Should Know About Wrongful Death Car Accident Cases
Being deprived of a family member is trying enough under any circumstances. When the loss was the result of a roadway wreck caused by a negligent driver or entity, it may make the already painful and devastating grieving process more challenging. When this occurs, the family of the deceased may have grounds for a claim against the other side to hold them liable for damages incurred. There are many ways where wrongful death may occur, and an experienced accident attorney may determine whether a particular incident may constitute wrongful death in California. However, there is a limited amount of time for families to take legal action against those responsible for their losses.
There are deadlines that apply to cases of wrongful death in California. These are called the statute of limitations. Per CCP 335.1, surviving family members have up to two years to file a lawsuit for wrongful death in civil court. The two-year statute of limitations does not apply in fatal accident cases that name a public agency as a defendant. In these matters, a time limit of 180 days or six months applies, according to the California Government Code Section 911.2. In other words, survivors must file a notice of claim within 180 days with the appropriate municipality. Failure to protect the applicable statute may result in the court’s dismissal of the matter. This may ultimately result in the loss of the right to seek damages.
