What Survivors Should Know About Wrongful Death Cases
The loss of a close relative is particularly heartbreaking when their death was the result of someone else’s negligence. The knowledge that the incident could have been prevented may make the loss even more challenging to come to terms with. In such situations, the surviving family members of the decedent may have grounds to file a wrongful death action against the at-fault party and their insurance company. When it comes to bringing such cases forward, California law limits the right to file to specific family members. Under the California Code of Civil Procedure Section 377.60, the spouse, domestic partner, or children of the deceased have priority when it comes to seeking financial compensation for their loss. Other relatives may be eligible for filing a wrongful death claim if such parties are nonexistent.
It is essential to keep in mind that such cases are subject to a statute of limitations, a deadline within which must be met when it comes to filing lawsuits in civil court. In California, eligible survivors must file suit within two years of the fatal accident date. Conversely, the two-year statute of limitations may be tolled in cases of minors. If the deadline is not met, the court is likely to dismiss the case, and the right to recovery of financial compensation may be lost.
Due to the challenges that may arise with such cases, it is essential to retain legal counsel right away. Without the right attorney by your side, you may not receive the favorable outcome you and your family deserve. Working with the best attorney in your area means that your lawyer will get to work on your case and will do everything in their power to ensure that your family receives the justice and financial recovery you all deserve.
