How Can a Wrongful Death Case Help Our Family?
A family that has experienced the unexpected loss of a loved one may be faced with immense emotional pain in addition to financial hardship. If the fatal incident was the result of another party or entity’s negligence, surviving family members that meet the criterion set forth in the California Code of Civil Procedure Section 377.60 may be eligible for the recovery of economic and non-economic damages through a wrongful death claim. This may include the costs of medical treatment from the decedent’s final injury to their time of death, mental anguish, expenses for funeral and burial services, lost companionship, loss of future financial support, and more.
Keep in mind that these cases require clear and compelling evidence demonstrating negligence on the part of the other side. That is because the legal process may be challenging to navigate when difficult insurance companies and defense counsel are involved. That is why a family must retain legal counsel to ensure that they are not taken advantage of by the other side in their time of grief and loss. Survivors can depend on their Madera wrongful death lawyer to work hard to secure the financial recovery they need. How Much Time Do You Have to File a Wrongful Death Lawsuit in California?
Like other civil cases in California, a wrongful death claim is subject to a deadline, otherwise known as the statute of limitations. Most fatal accident cases must be filed in civil court no later than two years from the date of loss to be admissible in civil court. In some situations, the period may be shortened to 180 days in those cases involving public agencies. Failure to follow the statute of limitations that applies to the claim may result in its dismissal and the loss of the right to seek financial compensation. Remember that strict filing criteria applies to wrongful death claim and may ultimately make or break a case. That is why it is essential to retain legal counsel immediately to provide an accident attorney with ample time to build a strong and compelling case for a successful resolution.
