What Damages Can Survivors Seek After the Loss of a Loved One in an Accident?
When a family member suffers fatal injuries in an accident caused by someone else’s negligence, survivors may face a wide array of financial and emotional challenges. Eligible surviving family members may be entitled to economic and non-economic damages. These are specific and will vary based on the facts and circumstances of the matter. Among the most common recoverable losses in cases of wrongful death in California include:
- End-of-Life Treatment: If the decedent required medical assistance for final injuries from the crash, surviving family members may be left with the costs of end-of-life treatment. The liable party may be held responsible for medical expenses from the fatal incident through a survival action.
- Funeral Service Costs: Survivors must pay for funeral and burial services following the loss of a close relative. These expenses may be significant, particularly in cases where the decedent did not have life insurance. Eligible survivors may seek reimbursement for the costs of funeral and burial services.
- Loss of Financial Support: In cases where the decedent was the primary provider of the household or financially contributed to the family’s household, their demise may also represent a loss of future financial support for survivors. The reasonable amount of lost earnings may be factored into a case.
- Loss of Benefits: Surviving family members may seek reimbursement for the loss of benefits they would have received from the decedent. This may include health insurance coverage for the immediate family, retirement and pension benefits, etc.
- Loss of Companionship: Damages for loss of companionship are intended to compensate survivors for the emotional aspects of the relationship they had with the decedent. These may include loss of companionship, care, support, guidance, and affection.
The California Code of Civil Procedure Section 377.60 allows the close relatives of the decedent to file a case against the at-fault party for financial compensation. Family members with priority for filing generally include the children, domestic partner, or spouse. Other relatives may have grounds for filing. This will be based on the circumstances and facts of the matter. For more information, reach out to our legal team at AutoAccident.com for a free case evaluation.
