Can You Bring a Wrongful Death Claim for a Single-Vehicle Accident?
Coming to terms with the loss of a close relative is trying enough. Knowing that they lost their life because of a preventable accident that was the consequence of another party’s negligence is even more challenging. While no amount of money may undo the pain of losing a family member or bring them back, filing a wrongful death claim may help surviving family members obtain the financial compensation they need to cover unexpected losses and a sense of justice knowing that the at-fault party has been held accountable.
Single-vehicle accidents may sometimes be linked to poorly designed and maintained roads. Conversely, damaged infrastructure or a construction zone that is not following safety protocol may also lead to these types of traffic collisions. In these situations, a claim may be brought against the government entity responsible for the design and maintenance of the public roadway. A shorter filing deadline applies to government entity claims, as outlined in the California Government Code Section 911.2. Such crashes may also be the result of a vehicle defect. When this is the case, the family of the decedent may bring an auto products liability claim against the automaker.
Whether you have lost a child, parent, or spouse, bringing a wrongful death case may help you recover the economic and non-economic damages you have faced. It is best to leave these cases to legal counsel with years of experience in the field. An experienced attorney may help your family build a strong case to present inside and outside the courtroom.
