What Surviving Family Members Should Know About Wrongful Death Cases
California law recognizes the immense harm that surviving family members may endure when a loved one is lost in a car accident caused by someone else’s negligence. The law is also specific on which relatives are allowed to benefit from a wrongful death claim in the golden state. Under the California Code of Civil Procedure Section 377.60, the decedent’s spouse, children, and domestic partner have priority when it comes to bringing a civil case forward. If such family members are non-existent, others that meet the criteria outlined in CCP 377.60 may be eligible for filing.
Financial compensation in a wrongful death claim is intended to make a family whole again. This may present in the form of economic and non-economic damages that are a direct reflection of financial burdens and intangible harms. They may include medical and funeral costs, mental anguish, loss of companionship, lost future financial support, and more. While no amount of money may replace or bring a lost loved one back, financial compensation may help bring closure to survivors knowing that justice has been served against the at-fault party and provide a sense of comfort knowing that they will have the means to provide for a more secure future.
