How an Attorney Can Help with a Wrongful Death Truck Accident Case
Dealing with the sudden death of a family member is devastating and often brings feelings of grief. Anger and frustration may occur when it is discovered that the loss was the result of an accident caused by someone else’s negligence. The aftermath of the loss may include unpaid expenses for medical treatment associated with final injuries from the crash, costs of funeral and burial services, and lost household income. Surviving family members may be reluctant to consult a wrongful death attorney after the loss of a loved one. However, an attorney may be of great help when dealing with such a loss.
An experienced Fresno truck accident lawyer can help survivors by handling all aspects of a wrongful death claim. This allows survivors the time they need to come to terms with their loss and focus on rebuilding their lives after a tragic truck crash. Working with insurance companies and defense counsel toward a favorable outcome in a big rig collision case is not always straightforward. That is because insurers are looking to pay as little as possible on claims to protect profit margins. Having an experienced accident attorney on your side is key to securing the financial compensation your family needs to move forward.
Another crucial aspect that is often overlooked in a wrongful death truck accident case is evidence. While families have up to two years to bring a case in civil court, it is essential to get started right away to secure and preserve evidence that establishes negligence and damages. As time goes by, evidence may be lost or destroyed. Aside from this, a different statute of limitations may apply if a government entity is named a defendant in a wrongful death matter. Under these circumstances, survivors have up to six months to file a notice of claim with the public agency. Failure to file may result in the court’s dismissal of the case.
