What is Wrongful Death?
The untimely end of a loved one’s life through a preventable accident is undeniably a tragic event. No amount of financial compensation can make amends for the profound loss experienced by the family of the decedent. In essence, a family permanently deprived of their close relative due to the negligence or recklessness of another party cannot be fully restored. Nevertheless, taking legal action against the opposing party, whether an individual or entity, is a crucial measure in protecting the family’s financial stability and future after the loss of a loved one.
Surviving family members often experience significant losses associated with a loved one’s wrongful death. They should not allow the opposing party accountable for the fatal incident to cause any further harm. Consulting with an experienced wrongful death attorney can ensure that a family’s future is protected. This should be done immediately due to strict filing deadlines for these matters. There is a two-year deadline that generally applies to cases of wrongful death. Furthermore, preserving crucial evidence is essential as it allows the attorney to properly prove what occurred.
Under the California Code of Civil Procedure Section 377.60, the right to seek financial recovery through a wrongful death case lies with the decedent’s children, domestic partner, or spouse. These relatives have priority for filing these matters, followed by other family members who depended on the deceased for financial support. An experienced attorney can understand your rights and options for recovery under California state law. At our law office, we offer free consultations.
