How a Wrongful Death Attorney Can Help Your Family

After losing a loved one in a motor vehicle collision, it may be challenging to cope with grief, all while going back and forth with insurance companies and defense counsel. A lawyer experienced in California wrongful death law can take the responsibility of handling verbal and written communication with the other side. An attorney can also help surviving family members by negotiating an insurance settlement or taking the case to court on your family’s behalf. To obtain financial compensation through a fatal accident case, it must be proven that the loss of life occurred because of someone else’s negligence and that surviving family members experienced damages as a result.

An accident attorney can help prove that the other side’s negligent action directly connects with the death of a loved one. By doing so, a family’s lawyer can present clear and compelling evidence in a wrongful death case. Common forms of evidence that attorneys use to establish liability in a fatal crash case is a traffic incident report, medical reports, forensic report, eyewitness accounts, video surveillance footage, photographs of the accident scene, and more. Some cases may require expert witness testimony. Your Modesto wrongful death attorney will work with experts in the field who can provide insight into the case, such as economists and accident reconstruction experts.

How Much Time Do You Have to Bring a Wrongful Death Case in California?

When your family has lost a member in an accident because of someone else’s negligence, you may have the right to seek compensation for losses incurred. However, California law requires survivors to file a lawsuit in civil court no later than two years from the date of loss. A skilled and compassionate attorney from our law firm can help your family through the process, including filing your lawsuit on time, to ensure that the court does not dismiss the case for failing to meet the statute of limitations.
