The area surrounding the accident was closed to traffic as an investigation into the cause of the crash was conducted by detectives. Additional information on the incident was unavailable.
Fatal Motorcycle Accident Causes Involving Motor Vehicles
Motorcycle fatalities in accidents involving cars and light trucks are often caused by the other vehicle’s driver failing to yield the right of way to a rider. The National Highway Traffic Safety Administration (NHTSA) reports that in 2018, drivers violating the right-of-way of motorcyclists were responsible for 42 percent of fatal two-vehicle crashes involving a motorcycle and another vehicle.
Negligent Left Turns Are the Major Reason for a Fatal Motorcycle Accident
Turning left in front of an oncoming motorcycle is the most common cause of a fatality or injury to a rider. Drivers often say they didn’t see the rider, however, in some cases, the motorist did but falsely assumed they could make their turn before the motorcycle reached them. This false assumption is because it is difficult to judge the distance and speed of a vehicle headed toward you. Other reasons can include distracted or drunk driving, which are leading reasons for traffic collisions.
Wrongful Death Claims Against a Negligent Motorist
When a family loses a loved one in a motorcycle accident, their lawyer will want to obtain all available evidence that may show the other driver was negligent. This might include obtaining witness statements, police reports, medical records and any video footage of the accident scene. The lawyer will also analyze the accident reconstruction report and any photographs taken at the scene to look for evidence of negligence.
Negotiating With the At-Fault Party’s Insurance Company
If it appears that the other driver was negligent and caused the fatal motorcycle accident, the lawyer will work to obtain a settlement from the negligent driver’s insurance company. The lawyer will present all evidence of the driver’s negligence and work to negotiate an agreement with the insurance company. Filing a wrongful death claim might include obtaining compensation for funeral costs, loss of income and other damages. If no agreement with the insurance company can be reached, the attorney can take the case to civil court to recover damages, including those for pain and suffering.
Protecting a Client’s Right to Fair Compensation
The lawyer’s clients can rest assured that their legal rights will be protected at all times when filing for damages following a fatal motorcycle accident. The lawyer will work hard to ensure that the negligent driver is held accountable for their actions and that the client receives the full compensation they deserve for their loss when filing a claim for wrongful death.
