Seeking Financial Recovery in Cases of Wrongful Death
One of the most trying situations that a family may experience in life is losing a close relative. This may be exacerbated in the case of a fatal accident caused by another party’s negligence. A case of wrongful death allows surviving family members of the decedent to seek compensation for the economic and non-economic damages they have experienced because of the other side’s negligence that caused the loss of life. A wrongful death action can help surviving family members manage unexpected financial hardship and provide a sense of closure, knowing that the defendant has been held liable.
Economic damages represent the financial impact on survivors. Eligible claimants may be compensated for the loss of the pension, benefits, or income that the decedent would have provided to the family household. They may also be able to recover the costs of end-of-life treatment the decedent received before they passed away (through a survival action), funeral costs, and other financial losses in connection with the wrongful death of a family member. Survivors may also seek reimbursement for non-economic damages like mental anguish, loss of companionship, etc.
