Compensation Following a Fatality in a Pedestrian Accident
Families of pedestrians killed in accidents caused by negligence can file a wrongful death lawsuit. The wrongful death lawsuit can be filed by the decedent’s surviving spouse, children or stepchildren who obtained at least half their financial support from the deceased. There are a number of types of compensation available under wrongful death law in California:
- Expenses associated with burial and funeral services can be recovered.
- Loss of consortium, comfort, moral support and affection may be recovered by the surviving spouse.
- The decedent’s wages until retirement age, including pension and insurance benefits, can be recovered.
- The decedent’s inability to provide training, care and guidance to the children can be recovered due to the loss.
- In some cases, the beneficiaries may recover the amount they would have received from the decedent’s estate if he or she had lived.
- Additional losses can be recovered that include those associated with household services such as childcare, tax preparation and lawn care.
- A survival action can be filed by the estate when a person lived for some time before dying, which can recover any medical expenses incurred by the decedent before their death.
- If the death was egregious or intentional, the family may be able to claim punitive damages.
