Things to Know About Wrongful Death Pedestrian Accident Cases

When a motorist does not follow traffic laws and operates their vehicle without regard for others on the roadway, the likelihood of a traffic collision increases. When a driver’s reckless or negligent behavior causes injury to others, they may be held accountable for the incident and the resulting losses. In a fatal pedestrian accident case, the driver that struck the individual on foot may be held liable for non-economic and economic damages. Survivors may be compensated for funeral costs, loss of companionship, mental anguish, loss of earnings, and other relevant damages.

According to California law, a surviving family member claiming damages for the loss of a loved one has two years from the incident date to file a lawsuit. While the law contains some exceptions, the failure to meet this deadline may result in the case being dismissed by the court. When this occurs, the family may lose the right to seek damages. The time and effort that goes into building these cases is significant. As such, it is recommended that surviving family members retain legal counsel as soon as possible to protect their rights.

When a pedestrian is injured, or a family is deprived of a loved one due to a car versus pedestrian collision, the insurance carrier may often resort to defense tactics to reduce financial compensation for claimants. The insurer may often attempt to shift blame on the pedestrian for causing the incident. Under comparative fault laws in California, an injured party or surviving family member’s financial recovery may be reduced by the degree of fault that is assigned to the pedestrian. An experienced attorney will work to ensure that fault is not unfairly placed on their client in a pedestrian accident case.
