Details on the Fatal Pedestrian Crash on Main Street
The first to arrive at the scene of the car vs. pedestrian accident was a Stanislaus County sheriff’s deputy who performed life-saving measures on the injured party until emergency crews got to the scene. From there, first responders took over CPR on the injured pedestrian, who was said to have a severe head injury and no pulse. Unfortunately, the pedestrian was declared deceased at the scene.
Officials have recently identified the decedent as 38-year-old Jose Mendez-Alonzo. A GoFundMe page has been created on behalf of Jose Mendez-Alonzo and his family for final resting expenses. The investigation of the fatal pedestrian accident will be handled by the California Highway Patrol. Authorities reported that the sequence of events leading up to the incident are unknown and currently under investigation. Additional information on the crash has not yet been released by CHP traffic officers.
What Families Should Know About Wrongful Death Cases
One of the most devastating experiences that a family may ever go through in life is the loss of a close relative. The grief may be compounded by frustration and anger if the loss was the result of a pedestrian accident that could have been prevented. The wrongful death of a family member may leave survivors overwhelmed with financial and emotional hardship. While no amount of money can bring a lost loved one back nor undo the pain of losing them, a wrongful death claim may help ease a grieving family’s financial burden. Bringing this type of case against the other side may also provide a sense of justice, knowing that they have been held accountable for the losses their actions have caused. These may come in the form of non-economic and economic damages. If the at-fault party has limited to no liability coverage for a fatal pedestrian accident, a family may have recourse through their uninsured and underinsured motorist coverage so long as the deceased was not excluded from the plan.
The California Code of Civil Procedure Section 377.60 states which surviving family members are eligible to bring a wrongful death claim forward. Those with priority for filing such cases include the decedent’s children, domestic partner, and spouse. Others who may have grounds if such relationships are non-existent include those who were financially dependent on the deceased. This may include the parents, stepchildren, and putative spouse. Conversely, survivors do not have an unlimited amount of time to file a case. That is because a two-year statute of limitations generally applies, as outlined in the California Code of Civil Procedure Section 335.1.

Your attorney will handle communications and negotiations with the other side in an effort to obtain a favorable outcome on your behalf.
