Who is at Fault for a Single-Vehicle Accident?
After a fatal single-vehicle accident, it is essential to understand that not all cases are attributable to driver error. That is because there may be other factors that may have contributed to the incident that may have been outside of the driver’s control. This may include defective vehicle parts and equipment and unsafe road conditions. In the former, an automaker may be held liable for damages resulting from a rollover collision if the vehicle involved in the incident failed to meet the Federal Motor Vehicle Safety Standard 216 that governs roof crush resistance. If the roof of the car fails to provide the structural protection outlined in this standard, an auto products liability claim may be brought against the manufacturer. In fatal car accident cases involving hazardous road conditions, it must be established that there is a defect in the design of the roadway or there was a failure to maintain the road.
When coping with the loss of a close relative, there are many practical, financial, and emotional matters that must be addressed and handled. Retaining legal counsel is essential to ensuring that you and your family’s best interests are protected throughout the legal process. When you have an attorney on your side throughout the process, you can focus on healing while your lawyer works with difficult insurance companies and defense counsel on your behalf. Remember that you cannot depend on the insurer to do what is right for your family as they are businesses at the end of the day. That means that insurance carriers may turn to defense tactics as a way of paying as little as possible on a claim. Your Modesto wrongful death attorney will not allow for that to happen and will work hard to secure a successful result on your behalf. Watch this video for suggestions on what qualities you should look for in a lawyer in your area to handle your claim.
Is There a Deadline on Wrongful Death Cases in California?
When considering taking legal action through a wrongful death claim, you should discuss your case with a lawyer immediately to learn about your rights and options for recovery. That is because there is a limited amount of time to bring such cases forward per the California Code of Civil Procedure Section 335.1. This section sets forth the statute of limitations for such cases, which is generally two years.
In those cases where a government entity is named as a defendant, there is a shorter time frame. According to the California Government Code Section 911.2, a notice of claim must be filed no later than six months from the date of the incident. Given the challenges that may arise in the legal process, it is without a doubt that the assistance of an experienced accident attorney will be useful in difficult times such as these.
