Details on the Fatal Solo Car Wreck in Madera County
Officers with the California Highway Patrol arrived at the scene of a single-vehicle collision involving a Toyota. A preliminary release revealed that the Toyota driver allegedly crashed, and this caused the vehicle to overturn. The Toyota came to a rest on its roof in a creek embankment, officials said.
The impact of the collision caused the Toyota to catch fire. Crews with the Madera County Fire Department were requested at the crash site to put out the vehicle fire, according to the California Highway Patrol.
Sadly, the two occupants in the vehicle suffered fatal injuries. Their identities have not yet been released. The cause of the solo car wreck has not yet been determined due to an ongoing investigation into the incident by CHP traffic officers.
Who is Responsible for a Single-Vehicle Crash?
Motor vehicle collisions are common in Madera County and throughout the state of California. Despite this, they are preventable if motorists exercise due care. While driver error is the common reason for car accidents, that is not always the case. Other parties may be held liable for damages in a fatal single-vehicle collision case. For instance, liability may lie with a government entity, an automaker, or a possible hit-and-run driver. In any of these scenarios, an independent investigation is necessary and should be left to an experienced accident attorney to handle.
A thorough investigation by a skilled lawyer may reveal that a public agency failed in its duty to safely design and maintain public roadways. Conversely, a vehicle manufacturer may be held liable for losses stemming from faulty car parts or equipment. Lastly, a hit-and-run driver may be to blame for a solo car wreck. To prove that a hit-and-run driver was involved, evidence at the scene may include strewn parts from the suspect vehicle, paint transfer, statements from eyewitnesses, and more.

How Much Time Do You Have to File for Wrongful Death?
In California, there is a statute of limitations that applies to wrongful death matters. As a surviving family member, it is essential to know the time frame in which you must file your case in civil court. In most cases, survivors have two years to file. In cases where a public agency is involved, the deadline is six months. Protect your rights as a survivor and retain legal counsel immediately to ensure that your claim is filed appropriately and on time.
