What Can Be Recovered in a Wrongful Death Case in California?

The loss of a close relative is a painful and devastating experience. Many things must be considered after an expected loss in the family. If it was due to someone else’s negligence or carelessness, there is one additional thing surviving family members should consider in their situation. This is taking legal action in the form of a wrongful death claim. It is essential to note that specific requirements apply to these cases, including who can file a case, the time limit wherein a case must be filed in civil court and the types of recoverable damages.

Those who can seek compensation in a wrongful death case are listed in the California Code of Civil Procedure Section 377.60. Priority for filing generally falls on the surviving children, domestic partner, or spouse. If no family member meets this category, other relatives who were dependent on the deceased may be eligible to seek reimbursement for damages in a wrongful death case. Moreover, these cases are subject to strict time limits known as the statute of limitations. Most matters must be filed within two years. A shorter deadline of six months applies to cases involving public agencies.

In some cases, survivors may be able to seek punitive damages in cases of wrongful death. Punitive damages against a negligent party are intended to punish them for their particularly egregious conduct. They also serve the purpose of deterring them and others from partaking in similar behavior in the future. These are generally awarded at the court’s discretion. In the context of a traffic collision, punitive damages may be sought from a motorist that was excessively speeding or driving while impaired. Specific criteria must be met in cases involving punitive damages.
