Is There a Deadline?
CCP 335.1 outlines the statute of limitations for filing a case of wrongful death. Under this law, surviving family members have a maximum of two years from the date of the loss of life to file in court. It is advisable that survivors get in touch with an experienced lawyer right away as there is considerable time that goes into building a strong case. Moreover, failure to file a wrongful death action within the applicable timeframe may result in the court dismissing the matter. Do not let this happen in your case, and retain legal counsel immediately to protect your rights as a survivor.
