Fresno Pedestrian Crash Fatality
A Fresno pedestrian crash fatality occurred on the morning of January 7 at the intersection of California Avenue and Martin Luther King Boulevard. A woman was crossing the intersection in the crosswalk when she was hit by an unknown vehicle. The driver reportedly fled the scene following the pedestrian accident, leaving the walker behind to suffer from her injuries. Emergency personnel responding to the scene transported the injured woman to a local hospital. Sadly, she passed away during hospitalization. Officials have identified the victim as 50-year-old Michelle Harvey of Fresno.
I would like to take this time to send my healing thoughts and condolences to the loved ones of Ms. Harvey.
Pedestrians Injured in Hit and Run Accidents
The likelihood of a walker being struck by a vehicle and suffering serious or fatal injuries are high, especially if the incident involves a hit and run driver. When this happens, an injured pedestrian can turn to their own automobile insurance policy for coverage only if they have uninsured/underinsured motorist protection. This type of coverage provides compensation to those injured in hit and run accidents for resultant damages. This includes medical expenses due to injuries sustained in the collision, lost income, disfigurement, loss of future earning capacity, and more. Conversely, the coverage may also be used in the case of wrongful death. To learn how to find a qualified attorney to handle your wrongful death claim, watch the following video.
Recoverable Damages in a Wrongful Death Claim
A wrongful death is defined as the death of an individual caused by the negligent or careless act of a person or entity. In the case of a pedestrian accident, driver error is a form of negligence. Those who meet the criteria of the California Code of Civil Procedure 377.60 may bring a claim for a loved one’s wrongful death for compensation of the following:
- Any medical expenses incurred before the passing of the deceased
- Benefits that are lost due to a loved one’s passing such as health insurance and pension
- Expenses of a loved one’s burial and funeral
- Cost of household services that were once provided to the family by the deceased such as home or vehicle maintenance, tax preparation, and childcare
- Loss of future income for the family
- Loss of the decedent’s affection, love, companionship, moral support, and comfort
- Loss of consortium
- Lost inheritance
- Mental suffering and anguish experienced by the unexpected death
