Filing a Wrongful Death Claim
If a family member has died due to a negligent driver while riding a motorcycle, you might be able to file a claim for wrongful death. A wrongful death claim is designed to provide financial compensation for the surviving family, funeral costs, wages and bonuses until retirement age, pain and suffering, and other damages they have suffered due to their loss.
Types of Claims in a Fatal Motorcycle Accident
There are two primary types of claims available when filing a wrongful death suit following a fatal motorcycle accident: a survival action and wrongful death. In a survival action, the decedent’s estate files a lawsuit on the deceased’s behalf to recover damages such as lost wages and pain and suffering prior to his or her passing. This action is on behalf of the person who died. The proceeds are then distributed among any surviving heirs or beneficiaries in accordance with state law.
In contrast, a wrongful death action following a fatal motorcycle accident is filed by the surviving family members, usually the spouse and children of the deceased, who are seeking compensation for their own losses such as medical bills, funeral costs, and lost companionship.
Filing Before the Statutes of Limitations Runs Out
In California, a wrongful death lawsuit will have to be filed within two years of the date of death. This time frame is known as a statute of limitations. Therefore, it’s important to speak with an attorney familiar with the laws in your area right away if you wish to pursue legal action against a negligent driver.
