What is Wrongful Death?
When a tragic fatal accident occurs, surviving family members are often left behind to mourn the loss of a close relative and deal with a mountain of financial challenges. If another party is to blame for the incident that claimed a family member’s life, survivors may be entitled to financial compensation in a wrongful death action. While life is priceless, holding the other side accountable for the loss of a loved one may provide much-needed relief in addition to a sense of justice and closure. What Wrongful Death Damages Are Recoverable?
A surviving family member may be able to seek reimbursement to address economic and non-economic damages, including:
- Costs of funeral and burial services
- Loss of companionship, mental anguish, and sorrow from the unexpected loss of a loved one
- Loss of earnings, benefits, and financial support that the deceased provided to the family household
- Expenses for medical treatment received by the deceased before they succumbed to their injuries (recoverable in a survival action)
- Punitive damages if the other side’s conduct that caused a close relative’s demise can be shown to be particularly egregious, like DUI or excessive speeding
Insurance carriers and defense counsel do not always have the best interests of survivors at heart. That is why it is recommended to retain legal counsel to protect your rights as a survivor.
