Rosemont Intersection Head-On Collision Involves Four Vehicles
A head-on collision in Rosemont resulted in the injury of one person at the intersection of Bradshaw Road and Ecology Lane on February 7, 2020. The collision, which happened at 1:22 in the afternoon, involved four vehicles, including a white SUV, a dark sedan, and a yellow delivery truck. It is unknown if the person’s injuries required that they be transported to the hospital for treatment. Three lanes were blocked due to the accident. The California Highway Patrol (CHP) is in charge of the investigation. There is no word as of the time of this report whether drugged or drunk driving was involved.
Head-On Collisions
Head-on collisions are often catastrophic and have the highest risk of fatal injuries. There is a 58-percent fatality risk associated with frontal impact crashes, according to the Insurance Institute for Highway Safety. They are more common in rural areas where two-lane roads predominate, and 13 percent of all fatal crashes are head-on collisions. The risk level in a head-on collision is fully dependent on speed. Low impact crashes have been shown to result in less frequent fatalities, while high-speed collisions often result in more serious injuries or deaths. If the vehicles involved in a head-on crash reach a speed above 43 mph, the risk increases. If the vehicles are traveling at 70 mph, the chance of surviving such a crash dips to 25 percent.
The most common reason for a head-on collision is when a driver misjudges the distance between them and an oncoming vehicle when trying to pass. Other reasons for a head-on collision are:
- Distracted driving: This occurs when a driver is focusing on something else rather than on the road. Often, the vehicle will veer into an opposing lane and place itself in position for a head-on crash.
- Drunk drivers: An impaired driver loses the ability to aptly judge distance and speed. This sets the stage for a frontal collision when they attempt to pass another vehicle.
- Fatigued driver: Falling asleep at the wheel for even a second can result in a head-on collision as the vehicle veers out of the lane and hits another.
Fault in a Head-On Collision
It is necessary to establish fault before your accident case can be brought against the negligent driver or his or her insurance company. The burden of doing this is on the injured party, who was not liable for the accident or the plaintiff. So, how does one establish fault? It is important to address the following:
- Duty of care: Every driver has the duty of avoiding harm and keeping other motorists, pedestrians, and bicyclists safe. To do this, the driver should maintain sobriety, focus on driving, and drive only when not unduly fatigued. This also includes care when taking prescription or over the counter medications that can cause problems for a driver.
- Negligence: Drivers are expected to operate a motor vehicle in the way a reasonable, prudent person would. If they deviate and drive recklessly, their behavior will be considered negligent. Such behavior includes speeding, acting aggressively, and disobeying traffic laws.
- Causation: Proving causation is essential in a personal injury lawsuit. Basically, it is necessary to prove that were it not for the person’s or entity’s negligent actions, the injury would not have happened.
What A Personal Injury Lawyer Can Do for You
At our firm, we send our investigators to the scene of the accident where they are able to gather evidence against the negligent party. To do this, they use accident reconstruction techniques, speak to witnesses, and obtain videos of the accident as it happened from traffic surveillance cameras. They also review police reports for inaccuracies because they are widely used in liability cases. Once all information is accumulated, the data is released to our legal team to build a strong case for our client.
