Things Families Should Know About Wrongful Death Cases
In California, wrongful death cases allow close relatives to seek financial compensation for the damages associated with the loss of their loved one. These claims are intended to make survivors whole again through the full value of the decedent’s life. This may include intangible value, such as the support they provided, the relationships between family members, and the care they offered. It may also be tangible in value, such as loss of future financial support, costs of funeral services, etc.
There are strict rules on which surviving family members can file a case for wrongful death in California. If there is a surviving spouse, child, or domestic partner, these relatives have priority in filing these matters. If the decedent did not leave behind such family members but is survived by other family members, like parents, stepchildren, or a putative spouse, these parties may be eligible for filing.
The statute of limitations, or the deadline, is usually two years for fatal accident cases. This means that if a loved one passed away in a car accident caused by a negligent driver, survivors have up to two years from the date of their death to file in civil court. While two years may seem like ample time, it is essential to protect your rights and best interests.
