Hit-and-Run Drivers
Leaving the scene of an accident, especially one that results in an injury or fatality, is a crime. It can be charged by authorities as a felony, so a strong effort is made to look for the perpetrator. Over the years, our law firm has successfully located many drivers who have fled the scene of a serious accident. When the driver is located, the injured party or grieving family may file for a personal injury or wrongful death claim. Among them, we use the following tools:
- Our investigative team goes to the bicyclist fatality site to look for clues as to the make and model of the vehicle and collect evidence to support the client’s wrongful death claim.
- The investigators perform accident reconstruction, which basically replays the bicyclist fatality collision as it occurred. This helps point toward fault.
- The accident report filed by the police is reviewed for inaccuracies.
- The investigators interview any witnesses to the bicyclist fatality accident. They often provide corroborating evidence, might recall at least a partial license plate, and someone may have filmed the collision as it occurred.
- Traffic surveillance and other cameras are examined to see if the collision was captured on video. This type of information can help locate the driver and vehicle.
Uninsured/Underinsured Coverage
Those who carry the add-on uninsured/underinsured policy on their car insurance in California are covered in the event of an injury or wrongful death. They don’t need to be driving when an accident occurs; they just need to carry the insurance. They might be walking, riding a scooter or bicycle, or even sitting at a bus stop. If the accident was caused by a negligent driver, this insurance covers the loss. In the event that a fatality occurs, the family of the deceased may place the claim.
