Pedestrian Accidents and Personal Injury Claims
A pedestrian accident has the potential to result in some of the most traumatic injuries on the spectrum. Even a collision at slow speeds may cause serious injuries or even death in some extreme cases. Drivers have a duty to follow the rules of the road and yield the right of way to others, including pedestrians. When a motorist fails to uphold their duty of care owed to a pedestrian and causes a traffic collision, they may be held liable for damages incurred through a bodily injury claim. Such cases are generally brought against the insurer representing the negligent driver.
There are some unique situations that may present in the claims process, some of which may include drivers without insurance or insufficient bodily injury liability coverage limits. In the former, an injured pedestrian may turn to their auto insurance policy for recourse if they have uninsured motorist (UM) coverage. This protection may come into play and cover accident-related injuries and losses up to the limits of the policy. In the latter, the injured party may bring a claim under their underinsured motorist (UIM) coverage if it has been determined that their damages exceed the other party’s insurance policy limits. If the pedestrian did not have an auto insurance policy but lived with a relative who carries UM and UIM coverage, that plan may come into effect in such situations so long as they were not excluded from the plan.
