What is Wrongful Death?
California law defines wrongful death as the negligent or wrongful act of one party that results in a loss of life. This may refer to a wide array of situations, including those involving motor vehicle collisions or other types of accidents. Surviving family members who have priority for filing are outlined in CCP 377.60. These include the domestic partner, children, or spouse of the decedent. This also includes family members who were financially dependent on the deceased if there is no surviving domestic partner, spouse, or children. Eligible survivors may seek reimbursement for intangible harm and financial losses.
In a fatal motor vehicle collision case, eligible surviving family members may file a wrongful death action against the driver responsible for the crash. The damages survivors may receive fall under two different categories, including economic and non-economic damages. Economic damages may include funeral service costs, costs of medical treatment before the deceased passed away (recoverable via survival action), loss of benefits, loss of financial support, and other financial losses. Non-economic damages are subjective and intangible in nature. These include mental anguish and the loss of companionship, care, and affection.
If the party or entity responsible for the loss of life acted in an egregious manner, surviving family members may seek punitive damages from the other side. These are intended to serve as a punishment for the negligent party and deter them from engaging in egregious conduct in the future.
