Accident Injures Three at Modesto Area Bank
I’m Ed Smith, a Modesto personal injury lawyer. Three parties were injured when a vehicle collided with a pedestrian and struck a bank in north Modesto recently. At approximately 2:03 in the afternoon, emergency personnel responded to a call of an injury-related accident at the Wells Fargo along Dale Road near the Vintage Faire Mall. The driver of a Honda Accord sedan was attempting to park their vehicle when they reportedly pressed on the gas pedal instead of the brakes, causing the vehicle to jump onto the sidewalk and collide with a 56-year-old woman walking with her husband. The Honda came to a rest after crashing through the glass wall of the bank. The woman was transported to an area hospital for treatment of serious injuries while the Honda driver and their adolescent passenger were treated for minor injuries.
Pedal Error Accidents
An accident of this nature is loosely defined as the act of mistaking the gas pedal for the brake pedal. This causes a car to accelerate rapidly. Although pedal error can transpire in a wide array of areas, it usually takes place at low speeds like a vehicle slowing down for an exit or parking. Due to the design of exit ramps and parking lots, motorists often are unable to correct the issue in time to avoid an accident.
Common Causes of Pedal Error
- A driver’s foot slipping from the brake to the gas pedal
- The motorist intending to apply the brakes but presses on both the brake and gas pedal
- Mistaking the gas pedal for the brake pedal
Reducing Your Risk of Pedal Error
- Avoid driving while distracted. Texting or making phone calls should be avoided;
- Pay careful attention when pulling into a parking lot or parking stall;
- Familiarize yourself with the gas and brake pedal locations of the vehicle you will be driving;
- Wear appropriate footwear for driving. Refrain from shoes that can cause your feet to slide off the brake pedal such as heavy boots, high heels, and sandals.
