Options for Financial Recovery After the Wrongful Death of a Loved One
There are no words to describe the unexpected death of a loved one and the immense hardship that may follow. It may become even more challenging when the loss was the result of a preventable car vs. pedestrian accident. While no amount of money may replace what surviving family members have lost or bring their close relative back, they do not deserve to bear the burden of any damages caused by another party or entity. California law recognizes the financial and intangible losses that come with losing a loved one in a crash and provides survivors the way of holding the other side liable through a wrongful death claim. When the incident was the result of driver negligence, surviving family members may file a wrongful death action against the at-fault party and their insurance company.
There are some situations that may warrant the utilization of the decedent’s uninsured and underinsured motorist (UM and UIM) protection. This may occur when it has been determined that the negligent driver has little to no liability insurance. What is great about this type of coverage is that it may be extended to other members of a household. So, if the deceased did not have auto insurance at the time of their passing, but their household member has UM and UIM, a claim may be brought under that insurance policy so long as the decedent was not excluded from the plan. Is There a Time Limit on Fatal Accident Cases in California?
While every wrongful death case is unique, surviving family members usually have up to two years from the date of loss to bring a lawsuit. The time limit may be shortened to 180 days if the case involves a government agency. Failure to file a wrongful death lawsuit in civil court within the specified statute of limitations may result in the court’s dismissal of the claim and forfeiture of the right to take legal action. This means that survivors may lose out on the essential compensation options they need. To prevent this from happening, it is crucial to retain legal counsel immediately to make sure your case is handled appropriately.
