How Are Wrongful Death Cases Resolved?

Wrongful death refers to a situation in which an individual dies due to the negligence or carelessness of another person or entity. When a death is the result of negligence, eligible surviving family members may have grounds to file a wrongful death claim. The purpose of a civil case is to seek compensation for the economic and non-economic damages suffered because of the untimely loss. A wrongful death may occur in a wide array of circumstances, and one common scenario is motor vehicle collisions, including bicycle accidents.

If it is proven through clear and compelling evidence that the loss of life occurred through the opposing party’s negligence, then compensation may be obtained through a settlement or by taking the matter to trial. Most wrongful death claims for fatal motor vehicle crashes, including bicycle accidents, are resolved through a settlement. If a mutual agreement cannot be reached with the insurer and defense counsel, the right California wrongful death lawyer will not hesitate to take the matter to court and seek the favorable resolution that surviving family members deserve.

While a two-year statute of limitations generally applies to most cases, it is a good idea to speak with an experienced lawyer well before the deadline approaches. An attorney needs time to gather evidence supporting the claim for damages. The longer the time between the loss of life and taking legal action, the more challenging it can be for the attorney to locate witnesses and crucial evidence before it is lost or destroyed.
