Big Rig Crash on Main Street in Modesto Area

Officials reported a big rig crash on West Main Street and North Faith Home Road in the Modesto area on the morning of June 18, 2021. The crash occurred shortly after 11:50 a.m. and involved a semi-truck and a Ford Explorer SUV.

Details on the incident, including what caused it and the number of injured parties, were not immediately available. An investigation is underway by the California Highway Patrol (CHP).

Who is at Fault for a Modesto Area Big Rig Crash?

Most truck accidents are the result of driver negligence. This may mean that liability may lie with one party’s poor decisions. Some of the common reasons for truck driver negligence may include distracted driving, falling asleep at the wheel, speeding, and more. These are some of the various ways in which a trucker may be considered liable when it relates to a big rig crash. That said, others may be held financially accountable for damages incurred.

One is the truck company that employed the trucker. There are many state and federal laws that regulate the operation of trucking companies. However, that does not necessarily mean that they are followed. A trucking company may be at fault for a commercial truck accident if they hired a driver without sufficient experience and training, enforced work hours or deadlines that are in violation of Hours of Service (HOS) regulations, failure in routine truck maintenance, lack of proper background checks, overloading trucks, and more.

An 18-wheeler accident may also be the result of a vehicle defect. Failure to warn and notify truck owners of known defects are some of the examples of negligence by manufacturers. Since many parties may be deemed liable for a big rig crash, it is essential to speak with a Merced personal injury attorney who has years of experience handling commercial truck accident cases. An experienced injury lawyer may help guide you through this challenging process. For details on how to find the best attorney in your area, watch the video below.

Why are Big Rig Crash Cases Challenging?

Aside from the many parties that may be considered negligent for a truck accident resulting in injuries and damages, these cases are challenging because of the at-fault party being backed by a large entity and their team of insurance adjusters and defense counsel. Such a team will do everything in their power to place liability on the injured party and other defense tactics to offer the lowest settlement possible.

In the days and weeks after a big rig crash, an injured party may receive a phone call from the insurance company representing the negligent party. They may extend a quick settlement offer in hopes of the claimant accepting without realizing the true extent of their injuries and damages incurred. It is essential to speak with an experienced injury lawyer before discussing your case with the insurance company, as an attorney will know the best way to proceed in your particular situation.

Time is of the essence in such cases as a two-year statute of limitations generally applies, as outlined in the California Code of Civil Procedure Section 335.1. Other filing criteria and deadlines may apply as there are unique facts and circumstances involved in each case.
