Biker Killed in Stanislaus County Motorcycle Crash
A biker was killed after a fatal motorcycle crash near Hughson in Stanislaus County on the evening of Saturday, October 24, 2020. The deadly incident occurred at Baldwin Road and Whitmore Avenue at approximately 6:25 p.m. Edwin Medina-Corona, a 21-year-old man from Hickman, was riding his 2020 Kawasaki motorcycle westbound on Whitmore, approaching the intersection with Baldwin Road. A 67-year-old Turlock resident was driving a 2000 Toyota eastbound on Whitmore Avenue and reportedly failed to yield the right of way to Mr. Medina-Corona as he made a left-hand turn onto Baldwin Road, the California Highway Patrol (CHP) said. The Kawasaki crashed into the right rear of the Toyota, causing Mr. Medina-Corona to be ejected off the bike and strike the road. Sadly, he suffered fatal injuries at the scene.
Losing a Loved One to Wrongful Death
Few situations create as much confusion, stress, and grief as the unexpected loss of a close relative. It is normal for survivors to seek answers to why and how their loved one was taken away from them. When the loss was caused by the negligence of someone else, it is understandable that surviving family members want accountability and justice on behalf of their lost loved ones.
A family may often be left behind to pick up the pieces in terms of end of life medical expenses and final resting expenses. Surviving family members may also struggle with the unexpected loss of financial and emotional support that the decedent provided them in the past. When survivors are dealing with grief, they do not deserve to bear the burdens alone if their loss occurred due to someone else’s carelessness or negligence.
Surviving family members are allowed under California law to seek financial compensation for their loss from negligent parties through a wrongful death claim. Understandably, no amount of money can replace the care, protection, and support the decedent provided. However, a wrongful death case serves to bring compensation and closure to survivors.
Types of Wrongful Death Compensation Available to Surviving Family Members
The types of losses available for recovery through a wrongful death claim are those incurred by surviving family members and generally include the following:
- Funeral and burial bills
- Loss of protection, care, and companionship
- Lost financial support, household services, inheritance, and benefits
- Mental anguish and emotional trauma that resulted from the loss of a close relative
- Punitive damages in a wrongful death claim where the at-fault party was egregious in causing the loss of a loved one (e.g., excessive speeding or driving under the influence of alcohol or drugs that resulted in the fatal motorcycle accident)
To determine whether you have a valid claim, contact an injury lawyer who is experienced in handling wrongful death cases to review the facts and circumstances surrounding your loss. For a brief breakdown of these types of cases, watch the video below.
