Motorcycle Crash in Bryon
I’m Ed Smith, a Byron motorcycle accident lawyer, and I want to warn you about some of the dangerous roads surrounding your community. A recent motorcycle accident serves as one of many examples of these high-risk roads.
About the Accident
On April 13th, at approximately 4:00 p.m., an unidentified male lost control of his motorcycle on Camino Diablo, east of Vasco Road. The male then left the surface of the road and swiped a telephone pole. This sent the male and the motorcycle into a barbed-wire fence. He then came to rest in a nearby cow pasture.
What Caused the Crash?
According to the California High Patrol (CHP), the male lost control of the motorcycle after an unidentified white vehicle made an illegal u-turn in front of him. The car did not stop and no witnesses to the accident have stepped forward. The CHP believes that the hit and run driver may have also been speeding.
The male rider of the motorcycle was airlifted to John Muir Medical Center in Walnut Creek.
Emergency Response
The East Contra Costa Fire Protection District responded to the accident after it was reported at 4:07 p.m. Two engines initially responded to the accident. One engine immediately went and began establishing a landing zone for a helicopter.
CHP and local paramedics also responded to the accident. The paramedics stabilized the patient and loaded him into a REACH helicopter several minutes after arrival.
Injuries Sustained in the Accident
Emergency responders reported that the male sustained at least a broken leg. Because he was airlifted to the hospital, the motorcycle rider likely sustained more serious injuries.
Common Injuries in Similar Accidents
Motorcycle accidents almost always cause severe injuries to riders. The most common injuries include broken legs, serious back injuries, head trauma, and extensive chest trauma. In many cases, motorcycle accidents can be fatal.
Liability in this Accident
If police are able to locate the vehicle that made the illegal u-turn in front of the motorcycle, that person may be liable for some of the damages associated with the action. However, because CHP believes the motorcycle may have been speeding, this liability is likely reduced.
California insurance follows a fault-based system. This fault is based on the three duties of all persons traveling on roadways: awareness, avoidance, and following the rules of the road. Both the driver of the vehicle that made the illegal u-turn and the rider of the motorcycle, according to the CHP, violated the third duty and were not following the rules of the road. Because the motorcycle was aware of the other vehicle and attempted avoidance and the vehicle driver did not, some of the liability likely remains with the driver that made the illegal u-turn.
About Camino Diablo
Camino Diablo is a narrow and twisty road that runs from Antioch through Brentwood and into Byron. It is poorly maintained but has become a major thoroughfare for many locals seeking to avoid the extreme traffic on Highway 4. As a result, serious accidents regularly occur.
