According to a release by CHP traffic officers, a man was driving a 2015 Toyota in the slow lane and attempted to switch lanes into the fast lane. While doing so, the right front of the Toyota collided with the left rear of an SUV. The impact of the collision reportedly propelled the SUV off the roadway and down a dirt embankment.

What You Should Know About Fatal Traffic Accidents and the Claims Process
Wrongful death is a civil action in which survivors may seek recovery of damages from the party responsible for causing loss of life. Such cases may arise in a wide array of situations, including traffic collisions involving negligence. To hold the other party responsible for such claims, surviving family members must meet the burden of proof. In other words, it must be shown that the at-fault party owed a duty of care, breached that duty of care, that breach was the proximate and direct cause of loss of life, and the unexpected death resulted in damages.
A wrongful death case serves the purpose of providing compensation to surviving family members for the financial burden they have faced now and that of the future. It may also consider the mental anguish, loss of companionship, and other intangible losses survivors have experienced. However, the claims process is not always straightforward, and that is particularly the case when insurance companies have proven to be difficult to work with. Fortunately, an experienced Turlock wrongful death lawyer may assist families in determining the best way to proceed in their case, what filings must be met, and what to expect from their claim moving forward.
It is essential to keep in mind that wrongful death claims follow a strict statute of limitations. In California, all claims must be filed with the court within two years of the date of a loved one’s passing. This is by the California Code of Civil Procedure Section 335.1. Therefore, retaining legal counsel right away is essential in such cases to ensure filing criteria and deadlines are met. For details on how to find the best lawyer in your area, watch this video.
