Car Crash in Turlock Area Ends in Man’s Death
I’m Ed Smith, a Turlock car accident lawyer. A March 18 car accident at about 11:30 p.m. claimed the life of one man in a two-car accident at an intersection.
What Happened?
The accident occurred near the intersection of Keyes Road and Nunes Road. A 37-year-old man, driving a 2001 Ford eastbound on Keyes Road, suddenly swerved his vehicle into the opposing lane, crashing into a 2006 Pontiac traveling in a westward direction.
Result of the Accident
The woman, a resident of Atwater, was wearing a seat belt at the time of the accident. She was examined by medical personnel on the scene. Although she was experiencing some pain as a result of the crash, she chose to seek medical attention on her own. The injured man who allegedly caused the accident was transported to Turlock’s Emanuel Medical Center where he died about one hour following the incident. It was discovered that the deceased man was not wearing a seat belt at the time of the accident. While the accident remains under investigation as to cause, it is believed by authorities that the man may have been under the influence of alcohol at the time of the crash.
Liability When You Are in an Accident with a Drunk Driver
If you are in an accident with a drunk driver, you might wonder how this affects your claim for damages. For one, the act of drinking and driving is illegal in California. However, drunk driving is not the reason the collision happened. Rather, by drinking, the driver neglected the duty of care that a reasonable driver would use when behind the wheel, causing the accident.
In addition, if the driver was charged with a DUI, taken into custody or received a citation for drunk driving, you can use that as proof of negligence. If you are able, note who was actually driving the vehicle and if you witnessed the driver trying to get rid of evidence such as liquor bottles or drug paraphernalia.
